Daniel Jacobs, Of Counsel in the Los Angeles Office, argued against an appeal brought by Volkswagen in the U.S. Court of Appeals for the Ninth Circuit.
EPGR is representing Professor Lawrence Kalbers in a Freedom of Information Act case seeking public disclosure of the secret evidence of the Volkswagen diesel emissions scandal. We successfully argued in federal district court that Volkswagen had waited too long to move to intervene and in the process misrepresented when it first learned about the case. After hearing oral argument on Volkswagen’s appeal, the Court of Appeals took the case under submission.
